POJOKSATU.id, JAKARTA – Sampai dengan saat ini, sudah empat laporan polisi dibuat terhadap Sukmawati Soekarnoputri terkait puisinya berjudul ‘Ibu Indonesia’.
Dimungkinkan, jumlah itu bisa saja terus bertambah mengingat banyak pihak yang tak terima dan merasa tersakiti.
Sebab, Sukmawati dianggap telah sengaja melecehkan syariat Islam melalui puisinya itu.
Bagaimana pendapat dan pandangan mantan Ketua Mahkamah Konstitusi (MK) Mahfud MD soal kasus Sukmawati?
Ternyata, Mahfud justru mendorong kepolisian harus secepatnya memproses kasus tersebut.
Demikian diungkap Mahfud MD di PTIK, Kebayoran Baru, Jakarta Selatan, Rabu (4/4/2018).
“Kan sudah dilaporkan ke polisi. Ya silakan aja diproses,” tegas Mahfud.
Ahli hukum asal Pamekasan, Madura, Jawa Timur itu menjelaskan ada pertimbangan khsusus polisi harus cepat memproses kasus ini.
Sebab, hanya dengan proses hukum saja nantinya bisa didapat kejelasan latar belakang dan esensi dari konten puisi Sukmawati.
Kendati demikian, Mahfud enggan berkomentar banyak soal ini.
“Saya dengarkannya yang bagus-bagus saja,” tutupnya.
Sebelumnya Kabid Humas Polda Metro Jaya Kombes Argo Yuwono menyatakan, polisi akan berusaha menjembatani pelapor dan terlapor untuk melakukan musyawarah.
“Mengingat masyarakat Indonesia ini adalah masyarakat yang bermusyawarah, berdialog, kita juga pihak kepolisian mengutamakan Restorative Justice,” ungkapnya.
Restorative Justice, jelas Argo, adalah upaya penyelesaian kasus hukum di luar pengadilan.
Akan tetapi, itu juga tergantung dengan pihak-pihak yang sedang bermasalah.
“Itu bisa, kalau memang nanti dilakukan kita bisa melakukan itu,” jelas Argo.
Namun, kata Argo, jika memang tak memungkinkan dilakukan Restorative justice terhadap kedua belah pihak, maka, pihaknya tetap akan menindaklanjuti laporan tersebut.
“Kalau tidak bisa dilakukan restorative justice, kalau memang itu suatu pidana, nanti kita lakukan pemeriksaan,” tegasnya.
Kendati demikian, lanjut Argo, pihaknya tetap akan menjalankan segala prosedur dan mekanisme hukum yang berlaku.
Karena itu, pihaknya tetap akan meneliti dan akan melakukan gelar perkara setelah melakukan pemeriksaan untuk mengatahui apakah ada unsur pidana atau tidak dalam pelaporan tersebut.
“Tapi, seandainya nanti misalnya ada pencabutan, ada musyawarah, nanti kita akan disitu,” tandas Argo.
